Study On Responsible Parties Of Compensation For Oil Pollution Damage From Offshore Drilling Platform

With Land oil resources are slowly dried up,offshore oil and gas exploration industry increasingly thrives,and oil spill accidents from offshore drilling platforms happen now and then.So oil pollution damage from offshore drilling platforms has become a problem that must be paid attention to.Offshore drilling platforms' oil spill accidents,whether Gulf of Mexico Deepwater Horizon or China's Bohai oil field,have made great pecuniary loss and ecological damage,and made marine environment suffered a great threat.The problem of the compensation for oil pollution damage from offshore drilling platforms is an urgent problem needed to be solved after oil spill accidents.To determine the eligibility responsibility parties to bear the liability is a vital part of it.The thesis is divided into four chapters,except for introduction and conclusion.Chapter 1,is about the general description about responsible parties of compensation for oil pollution damage from offshore drilling platforms.This part discusses basic information of offshore drilling platforms,oil pollution damage and responsible parties of compensation.Lay the foundations for the following.Chapter 2,discusses responsible parties of compensation for oil pollution damage from offshore drilling platforms under international laws and foreign laws.This chapter analyzes international legislative trend,by discussing responsible parties under international convention,EC directive and non-government agreement.It discusses provisions of OPA90 and American juridical practice combining with Deepwater Horizon Oil Spill accident,in order to draw beneficial experience.Chapter 3,firstly discusses specific provisions of responsible parties of compensation for oil pollution damage from offshore drilling platforms under Chinese laws.On the basis of legislation actuality and offshore oil exploration practice,combining with our juridical practices,this chapter analyzes and discusses those parties of operator,contractor,co-developer,owner of offshore drilling platform and third-party with fault,who may be responsible parties.Chapter 4,summaries the deficiencies of domestic laws and regulations,and discusses enlightenments and references from foreign legislation and juridical practices.In order to protect the marine environment and the interest of victims,and ensure the development of offshore oil exploration industry,this part puts forward the outlook of legislative perfection.
