Bohai Bay oil spill which occurred in2011had a significant impact to China andwas causing a serious impact not only on the ecology of the Bohai Bay,residentsaround the Bohai Bay,but also on our existing the law system of impacted by the oilpollution damage compensation. oil spill of Bohai Bay caused by leakage ofoffshore oil drilling platform. From this accident, you can find the embarrassment ofthe defects of our existing law system of compensation for pollution damage, andjudicial practice. And the strong contrast is in2010, the U.S. Gulf of Mexico oil spill.Two similar accidents, but different affects. The parties and the Administration’sresponse, however,created a great contrast.This paper starts with the relationship between vessels and drilling Platforms,conduets a study on the legal Problems of the compensations for the Pollution damagecaused by drilling Platforms and Puts forward some suggestions for improvement ofthe legislations and judieial systems in China.The first part is the definition of offshore oil drilling platform. This paperelaborates the definition of offshore oil drilling platform and ship from internationaltreaties and two of China’s domestic law, in order to be able to resolve the offshore oildrilling platform can be applied to adjust the ship’s relevant laws and regulations.The second part of our existing system of compensation for pollution damagecomb. Chinese domestic law and to participate in relevant international treaties of thecomb, lays out the framework of our existing Oil Pollution Damage, legal system, andthen found that the problems and shortcomings of the legal system of oil pollution damage of offshore oil platforms, to improve China’s offshore oil platform for OilPollution Damage, laying the groundwork for the legal system.The third part is to improve the legal system of China’s offshore oil platformproposals. Start from the Bohai Bay oil spill and the contrast of the Gulf of Mexico oilspill. In the legal system, introduced the United States on the basis of proposedrecommendations to improve the legal system of China’s offshore oil platform, andhope that might occur in practice later be able to better solve the problem of oilpollution damage caused by offshore oil platforms.
