The development of socialist market economy has been driving the rapid rise of the urban real estate,the socialism new countryside construction,urbanization process forward continuously,make urban and rural dual structure gradually disintegrated,the massive influx of rural population city,the boundaries between the rural and urban gradually blurred,the construction of houses on rural land circulation problems emerge in endlessly.First of all,the farmers are working in,some even buy a room to live in cities,rural house then sit idle,idle for a long time cause the waste of resources;Secondly,with the development of economy,to housing collateral for bank loans to become a new way of financing,however,due to the particularity of farmers' houses where farmers can't mortgage the ownership of houses,making and city residents suffer from different treatment for the same time,create an unfair in fact.As a result,farmers housing problems have sprung up in the process of circulation.Some Chinese laws and regulations about farmer houses and less messy,although in recent years issued many policy documents and administrative rules and government regulations,and in full swing around the pilot,the farmer housing circulation situation improved,but on the whole systemic bad,efficiency is low.The city perfect mortgage system,farmers a long mortgage system construction.In order to better adapt to the development of economy and the deepening of rural reform,the construction of rural housing mortgage system is imperative.System standardized farmers housing mortgage system in China should be how to build? In this paper,based on this direction,first of all,to overview: farmers mortgage farmers' the history of the building property right system,farmers' mortgage reform trend and the superiority of the construction of rural housing mortgage system.Then,analysis the main body of farmers mortgage relations: the mortgagor and the mortgagee,mortgagor's basic conditions,whether in their own house set up mortgage,for others,financial institutions as the mortgagee's,but the natural persons,legal persons and other organizations can become a mortgagee? Second,discuss the farmers housing mortgage to set up the concrete operation process: the scope of the mortgaged property definition and value assessment;Mortgage established conditions,the consent of the collective economic organization,the purpose of the mortgage of restrictions;Mortgage registration contains basis and procedure,the determination of the registration organ and establish unified trading platform.Again,in this paper,the farmer housing mortgage implementation,including the right to implement the mode,the assignee of the qualification,disposal of housing land use right,so as to fundamentally solve the farmers cannot the plight of the mortgage in our country.Finally,establish risk compensation and insurance mechanism,perfecting the social security system for farmers,which adapted to the reform trend,promote economic development.
