The right of the residents is the basic right that every citizen should enjoy.with the development and reform of China's housing system,China's housing supply mode has now progressed from the 90's housing welfare system to the present "two-track" housing supply mode that combines market supply and government support.However,with the rapid development of China's economy,housing supply become highly commercialized,some low-income population like newly worked or newly employed college graduates and migrant workers can not afford high Housing prices,housing difficulties become prominent.In order to solve housing difficulties of these group and meet their housing needs,our country began to optimize the housing supply side,establish a housing security supply system based on public rental housing.Public rental housing is a kind of security housing,in which the government provide preferential policies to rent their owned houses to urban low-income families with the price less than the market,to ease the contradiction of housing supply and demand.In 2016,China issued“Some opinions on speeding up the development and development of the housing rental market ”,which proposed to form a basic,fair and sustainable public rental housing security system gradually,and stressed to improve the housing supply system,to expand the scope of public housing coverage,to achieve the monetization of public rental,to establish a housing system simultaneous of purchase and rent in the 13 th Five-Year plan.However,due to our country's imperfect legislation,China's public rental housing supply system have some problems,such as the legislative system is not perfect,the government's legal responsibility is not clear,the financing system is flawed,the land supply system is not perfect and so on.These legal defects restrict the development of public rental housing in China,against the low-income populations solve their housing problem.To solve these problems,we must improve laws and regulations related with the public rental housing supply system.This paper draws on the relevant researches abroad,and combines the relevant practical experiences of the domestic key areas,and discusses the public housing supply system in China in-depth degree based on the economic law.Firstly,it expounds the concept and legal characteristics of public rental housing in China.Secondly,it analyzes the legislation of public rental housing in typical areas such as Shanghai,Shenzhen andBeijing,and puts forward the main problems of the legal system of public rental housing in our country.Then through the discussion and comparison of the public rental legal system of the three typical countries abroad like the Britain,the United States,Japan,obtained some useful experience,such as a complete legal system,government leading role and have a sound financing mechanism and perfect land supply system.Finally,after discussing the legal basis of the supply of public rental housing,it is proposed to establish a perfect legal system for the supply of public rental housing,including the improvement of the functions of government and perfection of capital raising system and land supply system related with the provision of public rental system.The study on the legal problems of public rental housing is of great significance to the improvement of the legal system of urban housing security in China.
