The Public rental housing has become the most important part of the affordablehousing system nowadays. It concerns people’s life as well as the country’s economicdevelopment and social stability. With the development of economy many areaappeared a group which called “sandwich class". Their housing issues have graduallybecome a hot social problem. At present, the research of the academic part mainly liesin social science, public policy and value orientation of housing financing. But Lessfrom the perspective of the law, This article use the public rental housing system ofdomestic and foreign policy as the foundation, and analyses our country publicrental housing legal system theory.Firstly, this paper introduces the public rental housing system background and itssignificance. Next is about the overview of the public rental housing system. And theauthor make a depth-study on the public rental housing system history problem,which hope to elaborated the public rental housing system in China.finally to findhow to develop it. Next is the public rental housing system in legal theory research, Itmainly includes three parts. The first is for public rental housing system of theconstitutional theories. The fundamental rights of citizens analysis as perspective, theauthor hope to find the constitutional basis and theoretical supporting points of thepublic rental housing system. This was followed by the public rental housing systemeconomic analysis. Finally is about the public rental housing social theory analysis.The fourth chapter is the view of the public rental housing system. In this part isthe public rental housing system of foreign study. This part is not simply on theforeign experience of the generalizations, but the introduction to their respectivecharacteristics, as well as how to learn from it, finally I will draw some relevantconclusion of the foreign system to help domestic public rental housing system. ThenI will make a comparative analysis of domestic policy such as Beijing and Tianjing.And find the legal point of view of the system problems. Next is how to build ourpublic rental housing system. It is all about our country public rental housing specificsuggestions, from the perspective of policy, the right and investment and from thelegal supervision analysis. Finally I will put forward some suggestions on this topic. I hope that this thesis will studies our country public rental housing system in theexisting problems, and put forward reasonable suggestions. By researching the foreignhousing security legislation and the exploration of China’s public housing system Ihope that through the improvement of strong legislation, it can guarantee our countryto solve the housing problem as soon as possible and constructing harmonious society.
