| With the continuous improvement of market economy and legal environment in China, the construction industry gradually exposes its legal weakness after the barbaric growth. Construction companies generally take legal means to resolve problems afterwards, lacking of effective control of the legal risks in the enterprise management, lacking of proposing overall legal risk control programs to form comprehensive legal risk management system.Firstly, according to the view of legal risk's definition, this article analyzes the characteristics of legal risk in terms of construction contract. According to the practice of Chinese companies' legal risk management, the legal risk management procedure of construction contract among construction projects might be obtained on the basis of the normal risk management procedure.Secondly, by analyzing the present situation of legal risk management among construction companies' construction contracts, it can be concluded that the legal risks derive from external legal environment and internal reasons. After discussing the contract management procedure and the causes generated legal risk, this article reviews these two dimensions to identify the legal risks, then prepares the legal risks list. Through Delphi method to evaluate and measure the legal risks identified, using risk matrix to output the result, and then enterprises deal with the legal risks according to their own risk preference.Finally, by combining a practical example of a small private construction company, its legal risks of construction contract are identified, measured and evaluated for proposing specific analyses and control measures. |
