Research On The Function Transit Of Law Enforcing Supervision Of Local Politics And Law Committee Under The New Situation

In terms of the situation of China, the party committee's leadership and supervision over politico-legal affairs is not only has the reasoning sounded in the party spirit in politics, but also has the constitution foundation in law. However, the problem of the law-enforcing supervision function of local politics and law committee has been controversial of various social circles, even some scholars in the law field consider it shows the interference of justice that grass-roots politics and law committee is in charge of cadre management and case management. After third and fourth plenary sessions of the Eighteenth Central Committee, the Central Committee has called upon us to deepen the reform of the judicial system and to promote the process of Rule of Law, which makes the law-enforcing supervision function of local politics and law committee has taken on a new orientation and has more clear operability and institutional mechanisms. Yet, looking at the current situation, the law-enforcing supervision function of local politics and law committee is incomplete.This thesis is complied as follows. Firstly, it introduces the function orientation which before and after change of the supervising law enforcement separately, discusses the background and characteristics of the function transit, and especially analyzes five kinds of work such as records of reporting on important matters, cases evaluation and law enforcement inspection, cases coordination, cases supervision, judicial assistance, which after the change of the law-enforcing supervision function of the local politics and law committee. Secondly, this paper analyzes the current situation and character of the law-enforcing supervision function of local politics and law committee under the New Circumstances based on the sample of cases evaluation, complaint reporting involving law and litigation, judicial assistance of the law-enforcing supervision in the politics and law committee of east area of Panzhihua. Then, the predicament of reform of the function transit is analysed. Lastly, combining the several years experience of politics and law working, this text studied that how to gradually perfect the working of local politics and law committee and put forward solutions from four aspects, such as identifying the relationship between the leadership of law-enforcing supervision and the coordination function, Intensifying Publicity and perfecting supporting mechanism, structuring the cooperative culture of law-enforcing supervision, enhancing the construction of law-enforcing supervision team force.
