Research About The System Of The Law-Enforcing Supervision Inside The Police Of Our Country

As the important tool of the people's democratic dictatorship, the police organ of our country is entrusted wide powers in administrative law enforcement and criminal jurisdiction while shouldering the important historical mission of consolidating communist party's ruling position, safeguarding social stability and unity and ensuring that people live and work in a good condition. These powers grasped by police organs like a "double-edged sword", not only can be used to protect human rights, consolidate political power, but also can violate human rights and affect the normal operation of state power because of the abuse of power. Under the new historical situation, on the one hand, building socialism harmonious society and the protection of human rights need relocated the role of the police organ of our country and its people's policemen; on the other hand, the rampant separatist forces in Taiwan and Tibet and international provocation need maintain their original nature of the dictatorship and violence to a certain extent. Under this kind of situation, how to supervise the police organ and its people's policemen more scientifically and effectively and how to standardize the exercise of their powers become an important issue in front of CPC and the Government, therefore, studying how to further strengthen and improve the system of the law-enforcing supervision inside police becomes especially important.In this thesis, the first part has made a systematic elaboration about the general principles, the development process of the system of the law-enforcing supervision inside police and the related stipulation and practice abroad and in Hong Kong region, the second part has made a detailed analysis of the system of the law-enforcing supervision inside the police of our country in the status quo, analyzed deeply and elaborated the main problem and its causes lying in the current system of the law-enforcing supervision inside the police of our country while affirming the achievements. Based on the analysis in the second, the third part has proposed the corresponding perfect countermeasure from the following five aspects emphatically. First, questions about how to innovate the idea, improve the quality and enhancement the initiative and enthusiasm of accepting supervision at the angle of thinking; Second, to solve the question of chaotic basis for the supervision at present, the proposal concerning unifying the legislation in the system of the law-enforcing supervision inside police is offered at the angle of improving legislation and the supervision system; Third, specific perfect countermeasures are offered focusing on how to unite, coordinate and solve the division of labor among the supervision departments in view of the current unclear system and division of labor lying in the system of the law-enforcing supervision inside police; Fourth, the issue of scientific way, means and concept of supervision is discussed at the angle of scientific supervision; Fifth, the necessity of integrating the law-enforcing supervision inside police with the supervision of the citizen and the news medium is analyzed and proven at the angle of the integration between the inside and the outside.
