The Research On Letters And Calls Petition Management In Maritime Safety Administration System Under Ministry Of Transportation Of The P.R.China

With the System of Maritime Safety Administration under Ministry of Transportation of the People's Republic of China(MSA System)shifted from being Non Government Offices(NGO)to Government Offices(GO),the most urgent challenge is whether the managements can adapt to Laws and regulations for GO that have been passed recently years,and whether they can match the maritime supervision practices with corresponding law enforcement practice.For example,the "Administrative Procedural Law" requires maritime agencies at all levels adjust their original management job tasks and procedures according to the laws.The "Government Officer Law" requires officers under the MSA System to transfer their status from an NGO to GO,which including changes from mindset,individual behavior,system setup,responsibility setup,etc.The "Regulation for letters and calls petition" requires the MSA System rebuild their system structure and work procedure,etc.However,there has not been much practical,problem solving oriented research on how to improve the management system of the MSA System,especially on how to improve the management for letters and calls petition.Most of the researches from the MSA System still focus on the field of maritime supervision management and law enforcement business.There have been very explicit law,regulation system and detailed procedures for these subjects.There is not much adjustment can be done from the perspective of further regulations.On the other hand,the most research on letters and calls petition focus on whether or not the system should be abandoned,specific case study,and proposals for litigating the letters and calls petition process.There is no innovation to repeat the same research.Based on the summaries of historical letters and calls petition work that has been performed by the MSA system,this paper refers to "Regulation of letters and calls petition" and letters and calls petition system reform opinions,spirits from CPC Central Committee and State Council,Stat Bureau for Letters and Calls.It analyses the existing problems of the maritime letters and calls petition system based on the theory of people sovereignty,theory of the Administrative Relief system,modern theory of public administrative management,the theory of commission management.This paper also studied the specialty and experiences from similar agencies within China and from other countries in details.It recommends approaches for further regulate and formalize the maritime letters and calls petition managementThere are three outstanding key points comparing to other research results related to letters and calls petition.First,this paper applies the practices from the MSA System closely.It is based on the induced maritime management issue after the system reform.There is practical basis and room for theory research as well.The reform mentioned for letters and calls petition system doesn't break the existing policy frame,while leaving enough room for imagination.It provides an opinion for broader letters and calls petition system reform.Second,this paper analyzes the existing letters and calls petition system regulation and management in China.It provides a letters and calls petition design with the characteristic of China based on the theory of public administrative system.For example,the theory of people sovereignty reflects people's stand and opinion from our current letters and calls petition system.The theory of the Administrative Relief system reflects that the letters and calls petition system is a public,base-line internal conflict management system.The theory of commission management reflects the future role that letters and calls petition management plays.Third,this paper absorbs the advanced management experience.It brings perspective of how to enhance the current letters and calls petition and further improve and perfect it.Civilian conflict with state or local government solving system under us federal government,has high similarity with our current administrative bureau functionality.There are plenty reference that can be used from U.S.The Ombudsman system developed under European parliament also provides a strong reference for shifting letters and calls petition functionality to litigation bureau,and litigating the letters and calls petition process in the future.Some developed countries put a lot effort on improving public relations from their maritime administrative agencies,so they can prevent conflict from the bottom.This provided another solution for letters and calls petition system for our own maritime administrative agencies as well.
