Report On Letters And Calls System Operation Of H County In Hunan Province

The Letters and Calls System is one of the special rights and relief systems in China. To a large extent, the Letters and Calls System has a positive meaning for ease of social contradictions, stable social order during a quite long historical period in China. As the system reform is launched comprehensively and deeply, the function of the Letters and Calls System has been gradually alienated. Besides, because of the congenital deficiency in the Letters and Calls System, the operation of the Letters and Calls System is in a dilemma.This paper which focuses on the current hot social issues of "Letters and Calls" has studied the recent three years’ working condition of "Letters and Calls" in H county. By analyzing the present situation and typical cases of petition, this paper points out some main petition problems in H County, such as the stagnant movement of the Letters and Calls System, the prominent problems of petition letter related to law or suit and the serious phenomenon of disorder petition. The causes for these problems are analyzed from the aspects of the lack of right-protection awareness and judicial authority, the undefined functions and scope of application of petition letter, the lack of authorized responsibility and rights of the complaint reporting handling office, the unbalanced interests of petition letter and the lack of finalization mechanism of petition letter. According to the existing problems and its causes, this paper proposes the countermeasures for eliminating a fertile ground for petition letter, making petition scientific, correcting the understanding of petition orientation and ordering petition activities to be standardized.
