Research The Legal Issues On Policing Mediation Of Community In China

Accompanied with the development of community policing strategy in the Ministry of public security since 2006,community policing system in our country has been continuous innovation and development,On the basis of absorb the advanced concepts in Europe and other developed countries and combining the actual community policing policing in China,The development of community policing has achieved remarkable results.But with the development of modern society,the operation of community policing shows more and more problems,seriously restricted the development of the police work.Mainly manifested in the development of community policing,a large number of new and diverse contradictions and disputes has become the urgent need to solve the problem of community policing.But the community policing dispute settlement mechanism is not timely to establish,the mediation subject is unknown and unclear,government agencies,community organizations,community involvement did not play its due role,the public security organs become to a major player in mediation of conflicts and disputes,the public security organs bear a lot of non police work,far beyond the scope of public security organs and the tolerance range.Therefore,in order to solve the problem of community policing mediation,this article tries to analyze the problems of community policing mediation from the following several aspects,propose solutions,in order to solve the dilemma of sustainable development of community policing.The first part introduces the community policing mediation system.Based on the concept of community policing,the theoretical basis and operational mechanism of community policing,the present situation of the development of community policing mediation system in our country,Points out the necessity of the construction of community policing mediation system.The second part elaborates the problems in the mediation of community policing in our country.Mainly manifested in the delay in the construction of China's community policing mediation system and mechanism,community policing mediation body is unknown,unclear responsibility,The legal basis of the public security organs to mediate civil disputes in the community policing is not enough,government,community,community organizations participation in community policing is not enough,The ability of the main body of Community policing mediation is not enough,,the effectiveness of community policing mediation is not enough.The third part introduces the legislation of the foreign community policing and mediation system and the reference to our country.Including the development model and the legislative situation of United States,Britain,Japan,Singapore,France,Germany and other countries of the community policing and the mediation system.The fourth part puts forward the countermeasures to solve the problems of community policing in our country.Including the strengthening of community policing mediation system and mechanism construction,clear community policing mediation body and responsibilities,regulate the scope and procedures of the mediation of public security organs in community policing,using the spirit of contract to improve the enthusiasm of the participants to participate in the community policing mediation,enhance the ability of community policing mediation body,improve the legal effect of community policing mediation.
