A Study On The Leagal Issues Of Cooperation Between Public And Privatae In The Reconstruction Project Of Shanty Area

The government through public-private partnership with private companies to alter shantytown together,give full play to private companies in the capital,technology advantages,so that housing construction costs,public service efficiency.This is just to solve the current government financial investment can not meet the shantytowns reconstruction project needs financial difficulties,and to take the opportunity to gradually change the service-oriented government.This paper analyzes the feasibility of using public-private mode of co-transformation of shantytowns,enriches the contract offer and commitment theory,and clarifies that the cooperation agreement is set up to be submitted by the government to invite(bid invitation),private company offer(bid),government commitment(won the bid).And this analysis that the cooperation agreement is defined as a civil contract not only in line with the nature of public and private partnership model,a more dispute solution to provide a path.The nature of the agreement to determine the government and private companies in the process of cooperation in the process of the boundaries of rights and obligations,strictly limit the use of administrative power.The two sides in the process of implementation of the agreement is bound to measure their own interests,but in order to achieve the public interest,the rights and obligations of both parties through the agreement to be identified and bound to become the normative contract content of the top priority.It can be seen that the process of cooperation between the government and private companies is the process from the conclusion to the implementation of the agreement,and placed in the framework of civil contracts,to ensure that both sides enjoy equal rights and obligations,and ultimately achieve the balance of interests.
