On The Legal Nature Of The Owners' Committee

With the development of market economy,the process of urbanization in China has been accelerated,and the number of urban commercial housing construction has increased significantly.China's land market supply mode of bulk transfer,derived from the western countries and the relatively closed residential district different blocks,resulting in a Chinese characteristics of the property management area divided by the owners and owners committee.In recent years,with the enhancement of owners' rights awareness,the owners'assembly and the owners' committee as an organization to safeguard the interests of all owners is particularly important.However,because the current laws and regulations of our country have not been clear about the nature and legal status of the owners' committee,a series of legal problems have arisen.The first chapter of this article mainly combs the origin and development history of the owner committee in our country,combs the current laws and regulations to the standard system of the owner committee;The second chapter focuses on revealing and analyzing the problems faced by the owners' committee,such as the lack of administrative supervision due to the unclear legal nature of the owners' committee,the difficulty in resolving judicial disputes and the problems of corruption prevention and punishment;The third chapter analyzes the relationship between the owners' Congress and the owners'committee,and compares it with the social organizations,the residents' committee and the stock economic cooperative after the withdrawal of the village;The fourth chapter puts forward the idea that we can perfect the legal system structure of the owner committee based on the model of stock economic cooperation organization.Finally,the article also proposes that the improvement of the legal system should be adopted to strengthen the government departments,industries and property owners of the committee to monitor the proposal.
