A Study On Some Problems In The Construction Of Rule Of Law In Chinese Chamber Of Commerce

Based on the historical background of deepening reform and combating corruption,it is put forward in this paper that because China has not yet established a comprehensive system of chamber of commerce,the legal demands of market players are difficult to be expressed in a timely and effective way.The market and the government have poor communication.Although anti-corruption has achieved significant results,market players and the government's communication has become increasingly difficult.Directed by the policy of Chinese Party Central Committee,the extreme importance of rule of law in Chinese Chamber of Commerce in social autonomy is put forward in this paper.With the new round of "streamlining administration,instituting decentralization" to start,to achieve efficient social autonomy,the improvement of our community management system will be inevitably required.Chinese Chamber of Commerce,as the main combo of the market,play a key role in maintaining market competition order and reflecting the demands of businessmen,so the construction of rule of law in Chinese Chamber of Commerce has important theoretical value.The analysis of the value of rule of law in Chinese Chamber of Commerce is made in the first part of this paper.The importance of Chinese Chamber of Commerce in social autonomy is systematically expounded,including that Chinese Chamber of Commerce has natural advantages in the communication between government and market and in preventing corruption,that Chinese Chamber of Commerce can effectively regulate the market order to maintain the legitimate rights and interests of market players,that Chinese Chamber of Commerce is the important force to realize the modernization of social governance and supervise the government according to the law.After theoretically clarifying the importance of Chinese Chamber of Commerce,in the context of a comprehensive deepening reform,the expectations and requirements for Chinese Chamber of Commerce is discussed.The author suggests that Chinese Chamber of Commerce should give a comprehensive and true reflection of market information,and should make timely and accurate feedback to the relevant government departments.At the same time,Chinese Chamber of Commerce should strengthen self-discipline,exercise the functions in accordance with the law,put an end to any "power to rent" behavior,so as to re-establish the social image of Chinese Chamber of Commerce.Chinese Chamber of Commerce should also regulate its autonomy,strengthen the construction of rules and regulations within the framework so as to regulate its internal management.Finally,the discuss is made from the theoretical basis and the policy and legal basis of the rule of law of Chinese Chamber of Commerce,and the meaning and value of this paper is expounded from the angle of theory and policy.The second part of this paper is a theoretical analysis of the rule of law in Chinese Chamber of Commerce.This part starts from the current theoretical study and practical needs in China,and makes a theoretical analysis on the realization path of the modernization of the rule of law in Chinese Chamber of Commerce.The author proposes 3 realization paths of the modernization of the rule of law in Chinese Chamber of Commerce,which are that in law,science defines the nature of Chamber of Commerce,standardizes the self-discipline mechanism of Chamber of Commerce,and smooths communication between the Chamber of Commerce and the government.The third part of this paper starts from the practice of Chinese characteristic Chamber of Commerce.On the basis of extensive practice research,it puts forwards Chinese experience and problem in the rule of law in Chinese Chamber of Commerce,also,combined with the basic theory of government regulation and market economy,discusses the social function of the Chamber of Commerce and the theoretical basis for the Chamber of Commerce to participate in maintaining the order of market competition,and emphasizes the importance of Chamber of Commerce in the development of market economy.Finally,this paper discusses the critical theoretical issues on the rule of law in Chinese Chamber of Commerce from 3 dimensions,which are that new requirements for Chamber of Commerce submitted by Chinese modernization of the rule of law,legalization of Chinese Chamber of Commerce's position and function,and institutional proposals for the reform of Chinese Chamber of Commerce.Furthermore,this paper puts forward some theoretical suggestions for the realization of the modernization of the rule of law in Chinese chamber of commerce.
