Research On Relationship Between Vertical Management Department And Local Government

The relation between vertical management departments and local government has always been concerned in today's society.Its essence is central-local relation.In 2009,vertical management departments had accounted for 50% of the executive power departments.Since the third Plenary Session of the 18 th CPC Central Committee,the central government implemented vertical management in audit,environmental protection and other systems.There are 29 central government departments,5 provincial departments have implemented or explore to implement vertical management.The establishment of vertical management departments is to reduce the interference of local governments in areas where the central authority need to consolidate and strengthen.In practice,we find that it exists a certain relationship which is "dependence" and "expectation" between the vertical management departments and local governments.Local government believes that the establishment of a large number of vertical management departments is central government's distrusts,at the same time vertical management departments say they often need to ask for help when interact with local government.The central government strengthens control of certain sectors through vertical management may not be able to put an end to the impact of local government.The "informal operation" which in turn weakened the central control between local governments and some vertical management departments is common.In the next period,the central government restrict self-interested local governments through vertical management is the mainstream of central-local game.In view of this,it is of great theoretical and practical significance to explore the current situation,problems and countermeasures of relation between vertical management departments and local governments.This paper is based on the description of the current situation of the vertical management system of our government,taking Customs Department as a specific object of study.Then taking advantage of the data obtained through field investigation and focus on the current situation,existing problems of the relationship between the C customs and the provincial government of A province,next analyzing the reasons in the view of relation of central-local government and relation of Tiao-Kuai.Vertical management system is also very common in foreign countries,this paper take Japan,the United States as examples and try to find useful experiences in regulating the relationship between vertical management and local government.At last,under the background of "comprehensively implementing the rule of law",this paper propose countermeasures from promoting the division of powers in central and local governments by law,improving the construction of government power and responsibility lists,standardizing the vertical management system,exploring dispute resolution mechanism between the vertical management and local government.
