Empirical Research On The Circulation Of Right To Rural Homestead Legislative Text In China

Urban and rural land dualistic land system has been put into practice in China for a long time,in this background homestead and the auxiliary facilities in the countryside in our country was under strict restrictions,thus causing huge vacancy of rural homestead and housing which not only greatly hampered the rural economic development,but also caused a lot of social contradictions.With the rapid development of our social economy and the raise of the urbanization level,the existing land system does not meet the need of social development in our country.To solve the homestead and affiliated housing circulation problem properly,experimental reform has been implemented in many places trying to explore a suitable circulation method of right to rural homestead for China's national situation.In this paper,the present legislation about the homestead circulation around text was collected and analyzed,trying to find out the problems existed in the homestead circulation in the process,putting forward the corresponding countermeasures and providing practical support for our country to build rational land circulation mechanism.In this background,through consulting to a large number of literature data and normative documents and comparing the text content and forms of local legislation,15 collected local regulatory documents were studied and compared.This article includes three parts mainly,the first part is the introduction of research background and purpose,text collection methods,text collection scope and other aspects.The second part makes a general statement of the general situation of the circulation of right to rural homestead legislative text first,then analyzed the circulation of right to rural homestead legislative text from the subject,object,circulation form,circulation price,transaction age and transfer income profit distribution and so on.
