An Analysis On The Application Of The Competition Assessment System In The Telecommunication Industry

In June 2016,the State Council released the Opinions on the Establishment of Competition Assessment System in the Construction of Market System,which established Competition Assessment System in China and clearly stipulated the contents of the review subject,the examination mode and the examination standard of Competition Assessment System,And establish a basic framework for the implementation of Competition Assessment System.Competition Assessment System is an important system to establish the basic status of our country’s competition policy.Its implementation plays an important role in deepening the economic system reform and releasing the market vitality.This paper discusses the specific application of Competition Assessment System,and combines the specific situation of incremental policies and measures and stock policies and measures in China’s telecommunication industry,trying to explore the application of Competition Assessment System in China’s telecommunication industry,and combined with the implementation of Competition Assessment System in other countries.The paper discusses the possible shortcomings and suggestions of the Competition Assessment System in our country,so as to provide some reference for the future implementation of the Competition Assessment System.This paper contains four parts,the first part introduces the characteristics of China’s Competition Assessment System,the current situation of China’ s telecommunication industry and the necessity and urgency for the application of Competition Assessment System in the telecommunication industry.This part is intended to lay the groundwork for later discussion.The second part discusses the application of Competition Assessment System in telecommunication industry’s incremental policies and measures,and discusses the five aspects of review,including basis for review,review subject,review object,review standard,review procedure.Combining with the provisions of our country and the experience of foreign countries,And put forward the suggestions of application.The third part discusses the application of Competition Assessment System in telecommunication industry’s stock policies and measures,clarifies the current situation of telecommunication industry’s stock policies and measures,and discussed the " Telecommunications Stipulations of the People’s Republic of China" and "Regulations on the Administration of Foreign Investment in Telecommunication Enterprises".The fourth part describes the guaranteeing measures of Competition Assessment System in China’s telecommunication industry,including full play the guiding role of competition authorities,full play the protection of anti-monopoly law’ s enforcement,applying the evaluation from the third party,adopting periodical evaluation for the policy,improve the social supervision and responsibility investigation mechanism.
