| Climate warming is the one of the most serious global environmental challenges facing humanity.International transfer of low-carbon technologies can achieve good reduction effect,worldwide is the key to carbon reduction,also is the key to solve the climate crisis.Low carbon technologies has a worldwide distribution imbalance and updated quickly,also to promote the necessity of low carbon technology transfer had the very big.The rules of UNFCCC,as well as all previous climate negotiations are mentioned in the low carbon technology transfer,this article discusses the background of climate change,the problems about low carbon technology transfer.Low carbon technology transfer has received the attention of the international community,but unfortunately did not achieve good effect.This article uses the methods of literature study,comparative study,through to the low carbon technology transfer related international agreements,mainly under the framework of the convention,the series of agreements and climate negotiations results was summarized and combing,summed up under the framework of the convention,the protocol can effectively promote the cause of the low carbon technology transfer,and proposes the solution according to these reasons.Due to the nature of soft law convention,as well as its regulation system existence flaw and the lack of specific performance requirements,as well as domestic private interests rather than in the developed countries in the interests of the commitment of the convention is not completely consistent,the article proposes some solutions from three aspects.The provisions of the first is to perfect the UNFCCC,the second because of the low carbon technology transfer is often involved in intellectual property rights,this article from the provisions of the TRIPs in finding ways to promote low carbon technology transfer.The third point is to try to combine with relevant mechanism of the WTO,to establish new low-carbon technology transfer agreement. |
