Research On Digital Copyright Exchange Mechanism From The Perspective Of Law And Technology

At present,China's economy is in the new normal phase,implementing innovation-driven development strategy,promoting the transformation and upgrading of industrial structure,which have become the inevitable choice of China's economic development.Copyright industry as an important part of intellectual property economy,the contribution to the national economy is rising,which is the strategic emerging industries of China's economy development under the new normal phase.In 2015,China's copyright industry added more than 5 trillion yuan,accounting for the proportion of GDP reached 7.3%,and the copyright industry has become a pillar industry of China's economy,which plays an important role to promote the spread of our national culture and enhance the national core competitiveness.Into the digital network era,on the one hand,due to the rapid development of China's copyright culture industry,the demand for copyright exchange in reality is growing.On the other hand,the existing copyright system is facing the impact of digital technology,which didn't make timely and effective changes,especially the lack of digital copyright exchange mechanism,resulting in the blocked digital copyright exchange channel and the problem of massive digital copyright exchange.Followed by China's digital copyright infringement disputes continue to rise,which inhibiting the healthy development momentum of China's copyright industry.In order to solve the problem of massive digital copyright exchange,this study explores the establishment and improvement of digital copyright property rights exchange mechanism.This study takes the interaction between legal system and technology development as the angle of view,the research objects include the rights transfer of the digital copyright,the pricing mechanism,the support mechanism,and the guarantee mechanism.In the transfer of rights,this study analysis the model of sale,rental and financing,the emerging copyright securitization is regarded as a way to realize the copyright property rights,which is added to the means of digital copyright exchange.In the pricing mechanism,pricing is the premise of the transaction,proposes a new method of improving the traditional gains method of property valuation with large data analysis,establish a perfect digital copyright exchange platform to improve the market comparison approach.In the support mechanism,the construction of digital rights exchange platform as a trading hub and technical support.In the guarantee mechanism,the copyright publicity system is used to clarify property rights,and the copyright technology protection measures are used to prevent illegal use of copyright.In conclusion,in order to alleviate the existing copyright disputes,improve the efficiency and security of digital copyright exchange,so as to promote the sustainable and healthy development of China's digital copyright industry,this study focus in structuring the digital copyright exchange mechanism from the two aspects of the legal system and technology.
