Research On Legal System Construction Of Food Safety In China

Food safety is related to national economy and people's livelihood,affecting the stable development of the country.However,in recent years,food safety problems have intensified and show complex and diverse characteristics.In this context,the new "Food Safety Law" in October 2015 formally implemented,known as the "history of the most stringent." As the basic law in the field of food safety,it plays an important role in ensuring food safety,safeguarding the legitimate rights of consumers and so on.Even so,the food safety problem involves a lot of links from the field to the final consumption,only a good food safety system can completely cure the shortcomings of food safety.In this paper,firstly,I elaborate the concept of food safety and what is the so called the rule of law in the field of food safety and distinguish the concepts with Food Hygiene and other related concepts.Then analysis the problems of the food safety legislation,law enforcement,supervision,judicial status,in particular,the law enforcement is not treated seriously and the problem of punitive damages caused by sectional supervision.In the next chapter,I introduce the basic situation in European Union,America and Japan.Rely on this and combined with the reality of our country,puts forward some suggestions on how to improve the safety of food safety in China,how to comprehensive law enforcement and supervision system in China and how to improve the judicial protection of food safety.Through the formulation and revision of laws and supporting laws and regulations,to rationalize the mechanism of various systems in the field of food safety in China so as to establish a scientific,efficient and rule-of-law,non-loophole regulatory model.Only in this way,we can definitely prevent potential food safety risks and ensure food safety.
