Comparative Research On Legal System Of Civil Aviation Cyber Security

The civil aviation information infrastructure is a kind of multi type network and information system,which is related to the civil aviation production business.With the development of science and technology and the deepening of the theory,the scope of the civil aviation information infrastructure is gradually expanding,especially the critical information infrastructure of civil aviation,which is closely related to the flight safety and national security.In the civil aviation information infrastructure support mode,the legal protection is the most basic,the most fundamental way of security.The main international organizations(ICAO)and countries have adopted legislation to establish the protection system of civil aviation information infrastructure.ICAO use international standards and recommended measures to urge member states to implement the domestic law.The United States passed a series of laws and regulations to establish the standard system of critical information infrastructure protection.EU a series of directives to expand the EASA 's safety management authority.Germany use the special provisions of the transport industry,to solve the problem of the identification problems.Japan adopted legislation to build the system of obligation from the state to the citizens,and established the civil aviation cyber security supervision system.China's legislation fails to meet the security needs of civil aviation information infrastructure.The promulgation of the network security law has solved the problem of the lack of the basic law of security protection,but the legal system and the supporting system of security protection have not yet been implemented.China should base on national conditions,international cooperation,and foreign legal system of civil aviation information infrastructure protection,multidimensional construction of legal system,to form a special law system of civil aviation information infrastructure protection.
