Research On The Legal Protection Of Key Information Infrastructure

On April 19,2016,General Secretary Xi Jinping pointed out at the Network Security and Information Work Forum :"The country’s key information infrastructure is facing greater risks and hidden dangers,and its cyber security prevention and control capabilities are weak,making it difficult to effectively respond to national and organized "High-intensity cyber-attack",and proposed to speed up the construction of key information infrastructure security guarantees,and effectively do a good job of national key information infrastructure security protection.World security is an eternal international topic.The overall meaning of China’s national security not only emphasizes the protection of national sovereignty,but also includes the connotation of social development benefits,such as the security of cyberspace,economic security,public health,and social stability will be largely undermined.Maintaining the security and stability of key information infrastructure is of strategic significance for realizing the benefits of all aspects of society.Therefore,we must attach great importance to the construction of this field.With the rapid development of big data and the Internet,in recent years,China’s academia has attached great importance to the safety supervision in the development and operation of key information infrastructure.In line with the global trend of key information infrastructure protection and China’s actual needs,it is the ultimate goal of this paper to explore and determine the legal protection measures for key information infrastructure suitable for China’s national conditions,and to improve the level of legal protection.In order to cope with the various threats of modern cyber security,in recent years,China has placed an important position on the security of key information infrastructure and legal protection in related fields.Although,China has huge information and network facilities,and China’s relevant laws,regulations and strategic documents have been promulgated,it lacks a comprehensive and system protection model to protect the normal operation of key information infrastructure.Therefore,this article considers that the overall design of network security and key information infrastructure security needs to be improved,and a common legal protection model based on a strict liability system should be formed.In terms of specific protection measures,this article considers that in view of the current status and existing problems of the legal protection of key information infrastructure security in China,comprehensive protection should be carried out through a variety of means,such as comprehensive use of legislation and policy systems.It should be emphasized that the protection of key information infrastructure must be changed from a traditional passive emergency protection model to an active and positive treatment model for the timely processing and evaluation of dangerous information loopholes.It proposes to determine the value orientation of key information infrastructure security legal protection,specifically establish the identification steps and security supervision obligations of key information infrastructure operators,clarify the specific responsibilities of security supervision departments,and establish the connection of key information infrastructure security legal protection and network security level protection.It is hoped that China’s legal protection of critical information infrastructure security will become more and more perfect,in order to protect the interests of all aspects of our country,and that the legal protection system for key information infrastructure security will be improved in the near future.
