| With the coming and development of information age,information technology has changed people's life style as well as brought great convenience.At the same time,it also makes personal information to become an important value of resources.The computer and Internet technique which can break through time and space limitations,cause personal information to suffer an unprecedented destruction.It can be said that the information era has not only changed the function and value of personal information,but also changed the way we look at personal information.To a certain extent,the right to be recognized and established in the law is because of its serious damage and destruction.There is no doubt that citizens' personal information in our country is being used in flood,which not only destroys the control and domination of personal information,and even distorts the personal image and the personal dignity.Therefore,today legislative protection of personal information has become an important social issue.On the one hand,the protection of personal information has been included in the legislative plan,and has formed a completed legislative recommendations.On the other hand,the protection of personal information in our country still exists controversy and research gaps in many ways,especially considering the value and protection of personal information at the constitutional level is a relatively new topic.In contrast,some developed countries and the organization have many discussion on the protection of personal information and completed legislation.Under such background,this paper attempts to consider and analyze the value and significance of personal information from the perspective of constitution,and to prove the possibility and necessity of the protection of personal information rights.By analyzing and drawing lessons from the theory and experience of the legislation of the United States and Germany,to seek the way of legislation of personal information protection. |
