According Employment promotion refers to the process of promoting the employment of laborers by means of measures such as providing employment opportunities,creating employment conditions and training vocational skills by the state,society and employing units in order to guarantee the smooth realization of citizens' labor rights.China's population is large,the world's population and labor the most countries,employment problems are diverse,with the socio-economic development of transition employment,college graduates employment,rural labor surplus and other employment problems become increasingly serious.In view of the employment problem,the central and all levels of government introduced various policies to promote employment,establish and improve the public employment service market,with a view to reducing the unemployment rate to promote universal employment.However,these policies and regulations are too principled,only to stay in the slogan level,its swearing effect is far greater than the practicality of practice.At the same time due to policy volatility,resulting in employment in the practice of implementation of the chaos.Therefore,the scientific and perfect employment promotion legal system is very necessary for China's employment promotion.With the promulgation and implementation of the relevant system of employment promotion law,the legal system of employment promotion in China has been initially realized,but because the employment promotion law is the product of the legalization of employment promotion policy,the lack of operability.At the same time,because China's employment to promote the legal system of unemployment insurance properties,employment insurance in the unemployment insurance system is not the first function,can not effectively play its role in promoting employment.And because of the serious imbalance of China's economic development and the dualistic attributes of urban and rural employment,local governments for employment promotion funding is very different,urban and rural employment development there is a big gap,leading to employment-related labor market around There are significant differences in the implementation of employment services.In contrast,Taiwan's employment promotion has been developed for many years,with a wealth of practical experience,in the implementation of employment promotion has achieved very good results.Not only established an employment insurance system,but also promulgated a set of perfect and mature employment promotion legal system.In view of the high degree of similarity between the mainland and Taiwan in terms of social culture and legal system,the author hopes that through the comparative study of the legal system of cross-strait employment promotion,we will find the advantages and disadvantages of the two in the promotion of the legal system and the structure,Related to mature practical experience,to explore the emergence of the stage for the mainland to promote employment legal system.So that the mainland employment to promote the legal system more scientific and perfect,in order to maximize the employment promotion function,reduce unemployment,promote social stability,to achieve social and economic development of harmony and stability.
