The Legislative Power In Cities Divided Into Districts

On March 15,2015,the three session of the National People's Congress(NPC)adopted the decision on Amending the legislative law of the People's Republic of China,which was the first amendment to the law of the people's Republic of China since the promulgation and implementation of the law of the people's Republic of China in 2000.One of the main contents of the revision of the legislative law is to give the legislative power of all districts,so the number of local legislative bodies is far more than the previous 49 big cities."Legislative law" so to adapt to the needs of a modified local legislation,is conducive to the rational to achieve the optimal allocation of local legislative power,promote local economic and social development,realize the local governance of the rule of law,but on the other hand,we should recognize the local legislative bodies in the inevitable facing many difficulties and problems,based on this from the perspective of the structure of this paper made the following arrangements: The first chapter of China's municipal districts and legislative overview,introduces the concept,China's legislative districts and districts with characteristics of legislative significance.The second chapter take the theoretical analysis and practical perspective,analysis of the existing legislative districts of the city operation problems in the districts of the city,including the legislative power is not clearly defined,the larger city of legislative provisions are not coherent,easy umbrella,become selfish interests of the legislators lack of capacity,poor quality of legislation the supervision mechanism is not perfect,and many other issues.The third chapter points out that is proposed to further improve the city's legislative suggestions,to grasp the principle of rule of law(including the legal procedure and legal content),democratic principles and the overall principle.On this basis,the fourth chapter puts forward the specific countermeasures to improve the districts of the city of legislative power,the interests of all parties,including the districts of the city to further clarify the legislative authority to solve large city legislative problem,effectively balance(including clear departmental responsibilities,active exploration mode commissioned the drafting of public participation,and improve the supervision system()including the improvement of the existing supervision system and judicial supervision,good convergence and improve the public supervision and so on).
