A Study On The Legislative Power In Cities Divided Into Districts,China

Giving legislative power to all districts in our country is a bright spot after the2015 revision of the Legislative Law.The operation of the municipal legislative power in the district is closely related to the unification of the national legal system,the allocation of the legislative decentralization of the central district,the guarantee of local autonomy,and the promotion of the modernization of national governance,and so on.However,the district legislative power,as a new thing,has encountered some difficulties and problems in theory and practice.Although the core competence of the municipal legislative power in our country is mainly related to urban and rural construction and management,environmental protection and historical and cultural protection,the problems faced by the district legislative power in the operation are very severe.In order to overcome it effectively In order to ensure the legal,scientific and efficient operation of the municipal legislative power in the district,the problems encountered in the operation of the municipal legislative power in the district should be put into the orbit of the rule of law from the perspective of optimization.This paper is divided into four parts.First of all,the author makes a comprehensive analysis of the city legislative power of the district in China,which focuses on the scope of the legislative authority of the city divided into districts;secondly,it systematically discusses the basis and significance of giving the legislative power of the city divided into districts in our country;thirdly,it discusses the scope of the legislative power of the city divided into districts.This paper focuses on the analysis of the problems faced in the operation of the municipal legislative power of the district,that is,from three aspects: the deviation of the legislative concept of the legislators,the limited legislative ability of the legislators,and the imperfect operation and guarantee of the legislative power of the cities divided into districts.Finally,based on the analysis of the problems faced by the municipal legislative power in the district,the author puts forward the countermeasures,that is,the positive measures.To changethe legislator's legislative idea,to improve the legislator's legislative ability and to improve the protection of the city's legislative power in the district are the starting points and the starting point.From birth to present,the district legislative power of our country is not smooth,but a dynamic process of continuous development and perfection.Therefore,it is necessary to fully grasp the principal contradictions that have been or may appear in its operation,not to belittle minor contradictions,and to give full play to the subjective initiative of jurists in order to be correct and timely.Solve the problem of district legislative power efficiently.Only to achieve the above-mentioned,will be conducive to the further improvement of the city legislative power of the district.
