China 's Public Participation In Judicial Research

Public participation in the judiciary is an important part of the current judicial reform.The Fourth Plenary Session of the Eighteenth Central Committee of the Party pointed out that it is necessary to "ensure fair justice,improve judicial credibility","protect people's participation in justice"," People to promote fair justice." "Decision" not only reveals the people's property of our judicial system,but also indicates the direction and specific requirements of the judicial system."Public participation in the judiciary will enter a new stage in our country.This paper begins with the concept of public participation in justice,analyzes the concept of "public" and "participation",expounds the theoretical basis of public participation in justice,namely people's sovereignty theory,democratic consultation theory and social capital theory and analyzes the public participation in justice The second is that the typical public participation in the judicial system of jurisprudence and the system of magistrates are introduced and analyzed for the reference of public participation in the judiciary.Thirdly,the author analyzes the main problems of public participation in the judicial existence in the light of the present situation of public participation in the judiciary.The legal protection of public participation in justice is absent.In judicial practice,the problems of public participation in judicature and the lack of rationality in the subject of judicial participation in our country.Finally,in view of the above problems,this article through the theory and practice to actively explore the following solutions to improve the public participation in the laws and regulations of justice,improve the public participation in the judicial system,the judicial public participation in the rational guidance.
