A Legal Study On Marrakesh VIP Treaty

?Marrakesh Treaty to Facilitate Access to Published Works for Persons Who Are Blind,Visually Impaired,or Otherwise Print Disabled?(hereinafter as Marrakesh VIP Treaty)under WIPO administrated treaty was adopted on June 28,2013,which aimed at protecting the reading rights of those blind,visually impaired,or otherwise print disabled group via supplying published works with copyright limitations and exceptions. The Marrakesh VIP Treaty was the first multilateral, legally binding instrument primarily devoted to copyright limitations and exceptions and the first convention on human rights in copyright field, also the second one that points to the special protection of the disabled specifically following the Convention on the Rights of Persons with Disabilities in 2006.The take-place of the “Marrakesh miracle”brought the world many puzzles,people is confused about the background of formation,the understanding and application of contents of Marrakesh Treaty.Furthermore,only a small group of people has specifically researched the treaty systematically,some analyzed certain articles though.Therefore,it is very important that people research the treaty properly and concretely.In addition to the preface,the dissertation consists of three parts:The preface discusses the implications of the thesis,summarizes the state of research,the purpose of research and the methods of research.Part one,the analysis of formation of the treaty. This part mainly probes into the background of Marrakesh VIP Treaty and makes results of the necessity of it.Part two,the analysis of the norms of the treaty. The discussion mainly lays out by three aspects,mainly about testing the lawfulness of the domestic copyright limitations and exceptions regarding accessible format copies in three-step test perspective;the implementation system of cross-border exchange of accessible format copies.Part three,the effect of Marrakesh VIP Treaty put on China's Copyright Law.It mainly deliberates the present situation,flaws of China's copyright laws,and the demand it put on as China has endorsed the treaty,the author puts forward the modification and suggestion of China' Copyright Law.
