Research On Chinese Skilled Migrantion Law

Since 1980 s, various countries have developed and improved their technical immigration laws in order to attract international talent. Due to the late start in our country, the larger gap with the developed countries. The most important departmental rules are "Measures for the Administration of Examination and Approval of Foreigners' Permanent Residence in China" in attracting foreign talent. With the promulgated, it means China's legal system of skilled immigrants has been established. After the implementation of these Measures, it has a positive effect in terms of attracting the top talent. But the face of rapid economic development, this Measures' problems has emerged.The author in the first and second parts of the article discusses the reason and meaning in improvement of China's legal system of skilled immigrants. To point out the necessity and urgency in consummate China's legal system of skilled immigrants.In the third part of the article, the author lists the immigration review, evaluation systems and immigration fuse systems, and analysis functions of systems one by one.In the fourth part, author sorts China's legal system of skilled immigrants, and made a comparative analysis with other countries'. Pointed out that has a lot problems in the form of regulation, review and assessment system and integration system. In the fifth part author puts forward some recommendations on the basis of other country's experience and China's basic national conditions. Such as establish a unified immigration law to improve the problem of form, concentrated the authority of review and evaluate to a single department, establish an objective evaluation system with points and the right to work protection system. In terms of integration of immigrants, focusing on improve foreign talent's economic, social protection and living environment, make them more willing to stay in our country live and work.
