Study On Legal System Of Skilled Migration In China

Driven by globalization,migration between countries has gradually become a common social phenomenon.Among them,skilled migration has become an important means for countries to introduce talents.Skilled migration,as a kind of migration,refers to the behavior of certain people with professional skills who apply for migration to another country or region on the condition of their own skills.Those laws that set out the principles,rules and procedures for skilled migration constitute the legal regime for skilled migration.Although we are a party to the Convention relating to the Status of Refugees and the Protocol relating to the Status of Refugees,we officially became a member of the International Organization for Migration in 2016,and we also have relevant provisions on immigration in our national laws,such as the Constitution and the Entry-Exit Administration Act,as well as policy documents such as the Provisional Measures for the Introduction of High-level Talents Abroad and the Rules for the Introduction of High-level Entrepreneurship Talents Abroad,But it is undeniable that there is not a special law and regulation of skilled immigrants in our country so far,and there are many shortcomings and defects in the legal system concerning skilled immigrants,such as the late start of legislation,the imperfect legal system,the unclear procedural standards,and the outdated content of relevant laws and regulations.Further improving and perfecting the legal system of technical migration in China is not only the need to enhance international competitiveness and speed up the construction of a modern powerful country,but also an important link to realize the overall rule of law.Therefore,it is suggested to further improve the legal system of technical migration in China by drawing lessons from the excellent legislative experience of large countries receiving technical migration,changing the concept of legislation,formulating special laws and regulations on technical migration,clearly setting the standards for accepting technical migration in China,and establishing and perfecting the management system of technical migration in China.Legislation on skilled migration should adhere to the principles of national security,national interests,market orientation and the right to development.It is expected that our country can construct a legal system of technical migration suitable for its national conditions,meet the needs of the country for specific types of talent vacancies,and then promote the continuous improvement of China's comprehensive national strength and international competitiveness.
