The Overcoming Of “The Difficult Execution” About Civil By The Improvement Of The Social Credit System

Execution is elating to the vital interests of the public, it's also the last hurdle to maintain the dignity of law and achieve justice. The meaning of the law is to protect the achievement of the legitimate rights for the right holders, and the law is the only way to establish the authority of legal. Otherwise, the fair legal judgment will become invalid, and won't make any sense for the right holders. But in the judicial practice of civil execution in our country, since the for the execution on of legislation, the ineffectiveness of the enforcement measures, the lack of the legal awareness of people, the uneven quality of executives and many other reasons, "the difficult execution" issue is still grim.This paper started with the concept of "the difficult execution", and analyzed it's performance and hazards. After this, this paper also analyzed the causes and found out that it was caused by “the lack of social credit ". In recent years, China also carried out the practice about using the social credit system to solve the "the difficult execution". This practice has already rewarded remarkable results, but it has not made its full deterrent effect yet. Therefore, this paper analyzed the construction model of foreign social credit system, and compared it to the current situation of the credit system of China, to make suggestions for the improvement and execution of the social credit system, to completely solve "the difficult execution" problem fundamentally.Body section of this article can be divided into four parts: The first part is the overall overview about "the difficult execution ". It first defined the concept of the "the difficult execution ", analyzed its manifestations and hazards, and after the comparison of the causes, this paper also put focus on the root of it-- the imperfection of the social credit system.The second part is an overview about the social credit system. This section introduced the connotation of the social credit system, and the model of the credit system construction abroad, in order to compare and analyze the construction of the current status of the social credit system in our country.The third part is the application of the social credit system in the execution This section firstly analyzed the basis for using the social credit system to overcome the "the difficult execution", and then introduced the current situation of the execution of the social credit system. This paper mainly introduced its reflection in execution—the executive deterrence mechanism, analyzed the operating conditions about the deterrent of the network platform, the announcement of the list about the dishonesty debtor, the limit of the high spending, and the restriction of the departure, and at the same time this paper also used the case to illustrate its deterrence on solving "the difficult execution", in order to analyze the reasons for the reason of the insufficiency on this stage.The fourth part is about the execution measures about the social credit system. This part firstly analyzed the current station and the practice of the social credit system, and gave advises from perfecting property registration, creating credit trading system, establishing credit files, optimizing credit environment, and improving the terms of credit awareness.Hope it will fundamentally overcome the "the difficult execution" issue.
