Research On The System Of Foreign Labor Contracts In The Late Qing Dynasty

In the end of Qing Dynasty, with the modern continuous evolution of the western capitalist powers, the western countries gradually opened the crazy model of colonial exploitation and human trafficking in order to meet the greed for wealth. In the thriving flow of the western world, the closed China like"the hermit crab" had been gradually cracked shell by the western capitalist countries, the Chinese people naturally became the means and tools to satisfy their desires and continued to be collected. In fact, the overseas servant system that people accompanied with each other could be traced back to the Dynasties of Song and Yuan. In the late Qing Dynasty, with the passive openning of China's door, the signment of external unequal labor contracts like "trafficking in pigs" “coolies on credit" and " legal recruitment" brought serious disasters to our country's labors. The study to the system of external labor contracts in the late Qing Dynasty has a rich theoretical and practical significance. However, the academic research in China in this regard is not enough, or could study it only from a historical perspective, and does not interpret it specifically from the aspect of legal historical evolution,therefore there is a need to deeply explore it. The author mainly discusses it from four aspects, in order to provide benefit for the further study of the external labor contracts in the late Qing Dynasty.The first part: the overview of external labor contracts in the late Qing Dynasty. The part carries out the analysis from the conceptual level. Starting from the concept and characteristics of external labor contracts, this paper subsequently describes the origin of the external labor contracts and its evolutionary process in the late Qing Dynasty.in order to extract the topic of this paper.The second part: the relationship of external labor contracts in the late Qing Dynasty. This part is the main part of the full text,and the content is rich and concrete. Beginning with the relations of the concept of external labor contracts, this part will further analyze the expressional characteristics of the external labor contracts in the late Qing Dynasty. Subsequently this part would comprehensive interpret the parties(they could be divided into the Chinese laborers abroad and the western colonists) and their rights and obligations, which are considered as two basic elements of external labor contracts in the late Qing Dynasty.The third part: the systematic implementation of the external labor contracts in the lateQing Dynasty. This part is also the main part of this paper, and undertakes the above to describe the implementary process of external labor contracts in the late Qing Dynasty under the historical environment, including three parts that are the formation of external labor contracts, the solution of external labor disputes and the end of external labor contracts.The fourth part: the evaluation of the system of external labor contracts in the late Qing. As the end of this paper, the author carries out the the simple analysis and summary to the value of external labor contracts in the late Qing Dynasty.
