Research On Chinese Counter-terrorism Financial Sanctions Legal System

Terrorist financing is the economic foundation of the existence of terrorism. Counter-terrorism financial sanctions of can be effectively cut off sources and funds flows of terrorist, weaken terrorist organizations survive and activity, reduce the incidence of terrorist attacks. Because of this reason, the United Nations has developed a series of anti-terrorism conventions and related financial sanctions, resolutions. the United States, Britain and other developed countries also passed legislation to establish a counter-terrorism financial sanctions regime. Our country is victim of terrorism, we have been determined to combat terrorism with the United Nations and other countries by financial sanctions, and explores domestic legislation. But because of legislation of anti-terrorism financial sanction started late, with little experience, the legal system is not perfect financial sanctions, financing sanctions is not strong enough. In view of this, the authors use the integrated interdisciplinary research, comparative analysis, case analysis and other research methods, explore and improve China’s legal regime against terrorism financial sanctions:Firstly, this paper explains the concept of terrorism and Counter-terrorism financial sanctions, point out the legal characteristics of Counter-terrorism financial sanctions,introduces how the terrorist organization raise and transfer funds, analyze that unique effect the financial sanctions has against terrorism.Secondly,the paper conclude that China’s current legal regime against terrorism financial sanctions, introduced specific implementation methods, pointed out the shortcomings of the current anti-terrorism financial sanctions exist.In order to learn from the experience, find a solution to the existing problems, the paper research the counter-terrorism financial sanctions regime of international organizations and developed countries.Finally, based on the experience of developed countries and the reality of our country, the paper give some recommendations by improving the Counter-terrorism financial sanctions regime。...
