The Straits of Malacca and Singapore,between the Indian Ocean and the Pacific Ocean,is one of the most important shipping waterways in the world.It will necessarily be an important part of the 21st century Maritime Silk Road,which is of great significance for the development of the world economy.The navigational security situation in the Straits of Malacca and Singapore is alarming due to the growing issues of waterway maintenance and maritime piracy.What measures should be taken to ensure the safety of transit ships in the straits.Has become a matter of great importance for the coastal states.This thesis gives an in-depth analysis of the current navigational safety problems from the legal point of view,pointing out the obstacles existing in the current legal framework in resolving the Malacca Channel and the piracy problems.On the basis of the analysis of current situation,this paper offers some practicable suggestions and recommends that the Chinese Authorities should take legal action on the issues.The thesis is consisted of four parts.The first part mainly overview the general situation of the Straits of Malacca and Singapore,the navigation safety problems,and briefly introduces the current international legal framework for the passage of waterways and combating piracy problems.The second part of the thesis provides in depth analyses of the problems existing in the current legal framework regarding the solution of navigational safety problems,which is mainly due to the imperfection of the soft law of international cooperation obligations and the lacunas in the framework for punishing pirates.The third part of the thesis offers some practicable suggestions for the above-mentioned problems on the basis of analysis,and recommends that international cooperation should be strengthened to help the coastal countries in maintaining the passage of the waterways and establishing a perfect legal framework for punishing pirates in order to ensure the smooth and safe passage of the ships in the Straits.In the fourth part,from the standpoint of China,it is proposed that China should actively participate in international cooperation and fulfill its international obligations in this regard.Moreover,China should help the coastal countries in combating with piracy problem.International cooperation against piracy should be strengthened,on the basis of respecting the sovereignty of the coastal countries.
