A Study On The Regulation Of Criminal Law Related To Criminal Law In China

Drugs are used to make drugs,including equipment,raw materials and preparations,widely used in modern pharmaceutical and chemical industries.Drug crime is a crime from the production of drugs to the use of drugs to start the crime chain,drug crime is the crime of manufacturing drug crime upstream,no drug no drugs.With the internationalization of drug problems and the seriousness of domestic drug problems,drug crime has shown a high incidence.The "Criminal Law Amendment(9)" adopted by our country in 2015 has undergone a great deal of revision and improvement of the crime of drug control in order to better realize the role of criminal law and to effectively combat the crime of poisoning.However,as the source crime of drug crime,compared with other drug crimes,the theoretical circles of drug-related crimes and not much concern,the study is not enough depth and comprehensive,leading to social awareness of drug crime is not deep,so that People can not really pay attention to drug crime.This article attempts to start from the criminal law on the initial exploration of drug crime,hoping to understand the basic problems of drug crime,and the improvement of China's criminal law to make recommendations.Because of the current research on the crime of drug-making crime at home and abroad,this article also mainly based on international conventions and foreign criminal law,including the provisions of China's criminal law and administrative law,combined with specific anti-drug practice,using citation and induction method,The basic problems related to the crime of drug-related products and the specific criminal law regulation in China.This paper is divided into four parts.Firstly,it analyzes the basic concept,characteristics and classification of the poisoned articles.Secondly,it analyzes the characteristics and shortcomings of the criminal law regulation of the poisoned articles in our country.Combining with the relevant criminal law provisions of international and foreign countries,Probing into the Legislation of Drugs.The value of the paper is based on a comprehensive analysis of some of the drugs,summed up the experience of international and foreign legislation,combined with China's specific judicial practice,China's drug crime laws and regulations put forward a feasible proposal.
