Research On The Japan Legal Regime Of The Nuclear Emergency

Japan is a disastrous country,with particular emphasis on disaster emergency processing,having a perfect legal system of disaster.Before Fukushima nuclear accident,Japan as a nuclear power country,it has relatively complete legal system construction of the nuclear emergency.However,the occurrence of Fukushima nuclear accident broke the Japanese "unbeaten myth".But it does not make negate on Japanese nuclear emergency legal system.These only shows that Japanese nuclear emergency legal system still exist deficiencies.And during the three nuclear accidents in the world,Fukushima nuclear accident was the most recent hanppening,including epochal issues technology,such as law,management and others.So the research on the Japanese nuclear emergency legal system has more significance and reference value of the Times.In this paper,on the basis of Japanese specific nuclear emergency law,combined with a large number of international treaties,national laws and regulations as well as academic monographs,etc,through the discussion of five parts,analysis dialectically the traits and problems of Japanese nuclear emergency legal system,and combining with Chinese nuclear emergency legal system present situation,put forward the corresponding suggestions.The first part: mainly through the analysising summary provisions relating to nuclear emergency legislation and theoretical research,summarize the specific meaning and scope of the nuclear emergency.Combining the meaning of nuclear emergency,it is concluded that the connotation of the legal system of the nuclear emergency.Then emphatically introduce the present situation of Japanese nuclear emergency legislation.According to the nuclear emergency range profile and the contents of the Japanese nuclear emergency law,Japanese nuclear emergency legal system could be divided into three regimes,namely the nuclear emergency preparedness regime,the nuclear emergency response regime and the nuclear emergency recovery regime.From the second part to the fourth part introduce detailedly the three nuclear emergency regimes,and summarize the traits of the three nuclear emergency regimes,and connecting with the problems arising from Fukushima nuclear accident,point out the problems in the three nuclear emergency regimes.Finally,it introduces the Japanese reforms aimed at the problems of the Fukushima accident emergency.The fifth part: it introduces the general situation of Chinese nuclear emergency legal regime,and dialectically analyzes the regime.Finally,drawing traits and problems of Japanese nuclear emergency regime legal,putforward some perfecting suggestions.
