Legal Research On Personal Information Security In The Age Of Big Data

The use of Internet information technology,people for the data collection,the use of growing demand.With the popularity and development of the Internet,cloud computing,Internet of things and other new technologies born,a direct result of the amount of data in recent years there has been explosive growth,thus promoting the arrival of large data age,personal information collection and utilization capacity has made a qualitative leap,our personal information in this network environment is faced with illegal collection,illegal use and leakage of the danger.Personal information security has become one of the most popular topics of public concern in China.Especially from this year shocked the country's "Xu Yuyu case" to Professor Tsinghua cheated 18 million,triggered a whole society of personal information disclosure of the status quo of high concern and heated debate.In the era of large Internet data,personal information is almost in the "streaking" state,how to change the status of personal information disclosure has become precarious.This paper starts with the concept of big data and personal information,introduces the challenges of personal information in the era of big data.Secondly,the analysis of the existing laws and regulations and the status quo of China's personal information protection,introduces the problems existing in the protection of personal information in China: Lack of special legislation;Lack of supervision of personal information protection;Narrow range of personal information protection;Legal relief difficulties;Lack of legal ideas.Thirdly,through the research method of comparative law,introduces the relevant laws and protection mode of the protection of overseas personal information,analyzes the legal protection mode of the United States,the European Union,Japan and Germany,and carries on the analysis summary experience.Finally,in view of the status quo of China's legislation and the existing problems,the author puts forward the countermeasures to improve the legal protection of personal information in the era of big data.
