The Security System Study On Disabled Elderly People's Legal Rights

Disabled elderly has weakness of economic difficulties,high dependence of family,large demand of nursing,low quality of life,and poor right protection consciousness.However,this is the epitome of disabled elderly in China.This thesis analysis disabled elderly problems from legal perspective,and find out that the relevant laws and regulations for disabled elderly are too general which lack maneuverability,specific procedures of judicial protection,transparency of law protection information,and relevant supervision system.The thesis discuss these problems into four parts with data analysis and theoretical analysis methods,in order to find the solutions.In the first section,the thesis brief introduces current situation of disabled elderly legal rights protection,and analysis problems of protecting legal rights.In the second section,the thesis uses relevant data and examples to elaborate disabled elderly legal rights protection problems and reasons.In the third section,the thesis focuses on the social protection system and social protection law in German,America,Japan,intensive study from disabled elderly nursing service,rehabilitation services,travel and transportation services,fringe benefits to find out suitable points for China.In the fourth section,the thesis focuses on the solution of disabled elderly problems.In order to establish legal protection system for disabled elderly,the government should improve judicial protection system,low down the difficulty of legal aid,expand legal aid scope,improve supervision.In addition,we should establish comprehensive feasible law guarantee system,improve nursing system of elderly,social insurance,social relief and assistance system.the present stage,the government should perfect the relevant legal documents for disabled elderly and improve relevant departments work,the disabled elderly could enjoy their service,the disabled elderly rights be protected.
