Research On Current Situation And Countermeasure Of Sexual Assault Suffered By The Female Children Staying In Rural Areas

Due to the uniqueness of the urban-rural dual structure of China,it is the choice of the times that the young labor force in rural areas goes out of the countryside for work and it is accompanied by a dramatic increase in the number of female children staying in rural areas.According to the investigation report of the the All-China Women Federation(ACWF),there are 61,025,500 left-behind children in rural areas,of which there are more than 28,000,000 left-behind girls.Due to the reasons of the absent responsibility of the guardianship,there are a considerable number of left behind girls suffering sexual assault.In recent years,the cases of sexual assault suffered by female children staying in rural areas were revealed by the news media continuously,such as " the primary school principal in Qianshan County of Anhui Province raping 9 girls","a 12 year old girl suffering from sexual assault by more than 10 middle aged and elderly people in Xingye County of Guangxi Province "," the financial aid sexual assault case of Wang Jie in Longlin County,Baise City,Guangxi Province" and " the sexual assault case of junior high school girls in Manchuria",etc.The public opinion was in an uproar and it also raised deep concern and study by the experts and scholars from the jurisprudential circle,judicial practice circle,sociological circle and psychological circle.The state and society pay more and more attention to the sexual assault cases of female children staying in rural areas and the relevant punishment and prevention work is proceeding in an orderly way.It is an indispensable and basic work to carry out intensive study on the sexual assault cases of female children staying in rural areas.Taking the sexual assault cases of female children staying in rural areas which were handled by the procuratorate in Y City of the Guangxi Zhuang Autonomous Region in recent years as the research object,based on the knowledge of criminal law and other related disciplines and materials from field survey,combined with previous research results and my practical experience of handling cases,based on the comprehensive analysis of the status,characteristics and cause of the crime of the sexual assault cases of female children staying in rural areas of Y City,my own opinions on the further punishment and prevention of such crimes are put forward in this article.This article mainly consists of four parts:The first part is the summary of the crimes of sexual assault of female children staying in rural areas.This part consists of four aspects: Firstly,the concept of female children staying in rural areas is introduced.Secondly,the relevant concepts of sexual assault of female children staying in rural areas are introduced.Thirdly,the general situation of female children staying in rural areas who is suffered from sexual assault is introduced.Fourthly,the general situation of female children staying in rural areas of Y City,Guangxi Province who is suffered from sexual assault is introduced.The second part is the characteristics of the crimes of sexual assault of female children staying in rural areas of Y City,Guangxi Province.This part mainly summarizes the criminal cases of sexual assault of female children staying in rural areas of Y City and summarizes the typical characteristics of the crime in the current social context,which mainly includes the characteristics that the campus and the surrounding area are the regions with high incidence of such kind of crimes,the subject of crime is mostly the "vulnerable groups",there is a higher proportion of committing a crime by acquaintance,the victims was hurt both physically and mentally and social relief is not enough,etc.The third part is the analysis of causes of the sexual assault of female children staying in rural areas.First of all,the problems of the lack of sexual rights in legislation,the difficulty in determination on the nature of the cases due to the legislation of the criminal law of our country lagging behind the social development situation,the defects of “The Law of the Protection of Juveniles” are analyzed.In addition,the problems of weak striking force against such kind of crimes,failing to build a new rural order effectively,lack of the identification and supervision mechanism for the guardianship of the guardian and the lack of sex education for girls are analyzed combined with typical cases.The fourth part is the prevention and countermeasures of the sexual assault of female children staying in rural areas.The main countermeasures are put forward from the following aspects: Firstly,evaluating the effect of the current regulations of criminal law in a timely manner so as to strengthen the contemporaneity,operability and effectiveness of regulations of criminal law.Secondly,improving the “The Law of the Protection of Juveniles” and implementing the guardianship.Thirdly,innovating on the criminal punishment and penalty enforcement measures of the sex offenders.Fourthly,strengthening the relief of the victims so as to help them to return to school and society successfully.Fifthly,Popularizing the sex education and preventive education of sexual assault for the left-behind children in rural areas.
