Study On The Dilemma And Countermeasures Of Law Enforcement Of People's Police XX Prison

In our country, the people's police are subject which is in line with the characteristics of our country in prison. The people's police do not only execute the punishment in the prison, but also it's the symbol of the state power in our country. Enforcement of prison police is not only related to the reform of Prison Criminals and the stability of the internal management of the prison, but also caused a certain impact on the development of the cause of the prison, and it's related to the stability of entire social for a long period.The current prison management work generally exist the problem of difficult law enforcement. Difficult law enforcement refers to the prison police encounter a lot of obstruction in the process of law enforcement. With the development of social forces, there are some underworld power and organization crime power. The development of these forces causes the increasing number of violence and deliberate killings in society. In addition,the consciousness of human rights is too high for prison inmates. T hey rejects the transformation of the prison, and they do not obey the police management which makes the prison work become more difficult.This paper adopts the method of literature analysis, collecting relevant literature on China's prison police law enforcement at home and abroad. This paper analyzes the status quo of relevant laws and the current management of prison police management, and it's combined with case analysis of XX prison as an example. This paper carries out the specific analysis and research of prison police encountered in the enforcement process with the problem. And this paper expounds the causes of these problems, and puts forward the corresponding solution of prison police enforcement dilemma, so as to solve the problem of the strategy and improve the level of China's law enforcement of prison police, and reduce prison police's law enforcement risk in our country, the protection of prisoners while maintaining social legal interests.The research content of this paper is divided into the following parts:(1) Explain the theoretical basis of the thesis. It analyzes the key concept of prison police's definition, law enforcement basis, China's prison police functions and China's prison police law enforcement related theories:the theory of public service, public products theory and crisis management theory. It lays a theoretical foundation for this study.(2) It describes the present situation of the law enforcement of the people's police in our country, and analyzes the dilemma and reason of the law enforcement of the people's police in our country. It mainly takes XX prison as an example, and analyzes prison introduction, the classification of prison criminals, and analysis of criminal background, legal supervision system and other aspects of the law enforcement status of XX prison. This part analyzes the current understanding of the prison law enforcement dilemma in the impartiality of law enforcement and challenges of civilized law enforcement, the deviation of prisoner right, difficulty of prisoner management and transformation, as well as China's prison police law enforcement risk which is combined with the current law enforcement analysis.(3) This part puts forward the countermeasures to solve the dilemma of law enforcement of prison police in our country. According to the above difficulties and problems, the countermeasures are including: the relevant laws and regulations on the enforcement of the prison management mechanism. Improve and perfect the reform of the prison law enforcement environment and the quality of China's prison police. Among them, regulate our prison police's law enforcement procedures and supervision system through further clear our prison police's law enforcement scope. Improve the prison related laws and the relevant legal system. Carry out the reform of prison police supervision and evaluation mechanism and guarantee mechanism of criminal reform of prison management system. Carry out the purification of prison police's law enforcement environment in China through proper guidance and purifying the social environment of public opinion.Inspect the prison police's daily behavior and improve the quality of prison people's police force by cultivating the quality of prison police, so as to solve some difficulties encountered in the enforcement of prison police's.
