The Research On Chinese Characteristics Of Construction Of A Society Under The Rule Of Law In China

The construction of socialist society with Chinese characteristics under the rule of law is an important part of comprehensively implement the rule of law.What is the basic mode of presentation and demand of Chinese characteristics in the construction of society under the rule of law? Although some achievements in academia have Chinese characteristics as the title,but in terms of content,such issues as the academic connotation of Chinese characteristics and that how to understand the construction of society under the rule of law have not well settled.Therefore,it is has theoretical and practical significance to study the Chinese characteristics in the construction of society under the rule of law,and explore the original meaning and requirements of Chinese characteristics with which the construction of society under the rule of law,in order to rectify the misunderstand of Chinese characteristics in society,scientifically grasp the scale of social construction with the rule of law and enhance the efficiency of socialist legal ideological education.Guided by the historical materialism way of thinking and compared with developed countries,the research synthetically uses literature analyzing method,historical tracing method and comparative research method to systematically study and generalize the basic requirements and concrete forms of Chinese characteristics in the theoretical and practical aspects.The full text is composed of introduction,main body and conclusion.The main body has three chapters.The first chapter generalizes the basic connotation of Chinese characteristics.Chinese characteristics are the theories and practices which creatively solve the problems of China,embody thenational excellent quality and draw lessons from the development of human civilization based on the reality on the premise of adhering to the basic socialist principle.The second chapter makes a contrast and theoretically explores the construction of a society with the rule of law.Persevering in the socialist legal system and developing socialist theory of rule of law in China is Chinese characteristics in the nature of constructing society under the rule of law;the establishment of a harmonious society is the Chinese characteristic of the goal in the social construction with rule of law;insisting in the party’s leadership and assure the dominant position of the people are the Chinese characteristics retained in the principle of constructing a society under the rule of law.The third chapter compares and studies the practice of construction of a society with the rule of law.Relying on institution and organization is the Chinese characteristics of the routine to promote the social legal construction;to absorb the essence of the traditional Chinese culture,Chinese culture of law and the revolutionary culture and combine it with modern culture of law to enhance law awareness is Chinese characteristic of how to construct the society under the rule of law;to adopt people’s mediation,follow the mass line,provide public legal service and strengthen the fundamental institutions are Chinese characteristics of the measures to construct the society under the rule of law.It draws a conclusion in the end.The consistent value of the construction is for people’s fundamental interests.The People-oriented idea delivered in the construction of the society with the rule of law deepens the connotation of Chinese characteristics.
