Research On Construction Of The Socialist Rule Of Law Government With Chinese Characteristics

The rule of law is the solid foundation of human civilization. Human beings put maximumly their destiny in their own hands just after taming the power of the government by the rule of law.The rule of law and representative democracy are considered as the shed of civilization and savagery. In contemporary China, the construction of rule of law government is the priority of fully advancing the law-based governance of the country and the key to the modernization of governance.Since the reform and opening-up, the socialist system of laws with Chinese Characteristics has been built, construction of the rule of law government gradually back on track, the power’s running is gradually normalizing, the level of service and transparency is improving and so on. but because of various reasons such as the system of check and balance is inefficient, the boundary between the government and market is obscure, the negative influence of traditional tyrannic culture, the lack of contemporary civic culture education, a long history tradition of strong government and so on, the power of the government have not yet been effectively restricted, low institutionalized level of market economy, rational citizen culture has not been formed, low level of social autonomy, which are restricting the construction of the rule of law government.Compared with the western government,the socialist rule of law government with Chinese Characteristics has both general and particularity, which requires the construction should absorb the advanced experience from the other states,combine concrete national conditions and embody Chinese characteristics, adhere to the leadership of the Communist Party of China, adhere to the interaction between of government and society. The rule of law government construction is a complex and systematic project, but it does not mean that it must be a hundreds of years of historical evolution, through the investigation of the history of countries which have built the rule of law government, we can sums up the necessary conditions of rule of law government:the impeccable democracy, mature market economy, the rational citizen culture, fully social autonomy. On this basis, combining the problems and reasons of construction ofrule of law government, these countermeasures are must be executed: Enhancing the construction of democratic politics, strengthen the supervision from People’s Congress and judicial authority; Improving the modern market system, government should play a better role and protect property rights faithfully; Establishing and perfecting the civil education system; Promoting social autonomy, elevating the level of grassroots self-government and self-governance of social organization.
