The Study Of The Problem Dual Nationality In China

As the interaction between countries has become more frequent,the transnational marriage,visiting relatives,immigration,adoption,and other forms of international exchange also arise.The dispute need to seek solutions will related with the nationality of citizens.However,each sovereign state to made this policy according to the international society the history of the development background,national culture,various nationalities psychological consciousness is suitable for the country's nationality policy.It is difficult to form a unified world nationality law in the world,and will inevitably produces dual nationality problem.In the context of international conflict due to the conflict of nationality,many experts and scholars have begun to discuss the advantages and disadvantages of the dual nationality system,demonstrate their own ideas from multiple perspectives.In fact,the issue of dual nationality is becoming more and more prominent in our country,it requires a legal system.It is great significance to further improve China's nationality system is to alleviating the nationality conflicts in China.In recent years,there has been a growing chorus of calls for recognition of dual citizenship,a question that has been raised at official meetings.At the National People's Congress in 2016,Liwai,a member of the standing committee of the national committee of the Chinese people's political consultative conference(CPPCC)and deputy chairman of guang dong's overseas Chinese federation,suggested the removal of "the automatic loss of Chinese citizenship to Chinese nationals who obtain foreign nationality".He discussed the advantages and disadvantages of nationality at the meeting,then analyzes current domestic situation and international trend and concludes that our country should adopt a limited recognition of dual citizenship.Dual citizenship can be studied in several academic fields,it is an important system of international law,it has unique research values.In this article,it by means of comparative analysis,historical analysis,method of law analysis and so on to study this problem from four chapters.First of all,from the related concept of dual nationality,it is concluded that in the practice of our country inevitably produces dual nationality question,at the same time show the attitude of dual nationality.Then,according to the legislation of America,India,Germany three countries shift,elaborated our country law policy evolution,the history of dual nationality of China and Indonesia signed the agreement,Hong Kong and Macao regions handle the nationality problem in practice is analyzed.On the basis of this,the present nationality law of our country faces the specific problems that exist in the process of dual citizenship.Finally,the proposal of improving the dual nationality of China is put forward based on the explicit recognition of the dual nationality.In the international community,attitudes towards dual citizenship in individual sovereign countries have been shifting.Through the analysis of the various problems encountered in the practice of the People's Republic of China law in China in 1980,we can make suggestions for improvement.It is believed that it is of great practical significance for our country to deal with the complex international situation.
