On The Perfection Of Supervision System In China

Since the industrial revolution,with the economic and social development,the government power has been expanding,and deepening the intervention of daily social life.The government gradually evolved from “night watchman”,the maintenance of social order and civil rights into the manager of public interest and provider of the public service.As a result,numerous problems have emerged,such as extravagance in the public sphere,abuse of power,corruption,inefficiency,and lower government trust.In order to strengthen the supervision and control of public power,especially the executive power,countries around the world devotes themselves into exploring the establishment of effective supervisory system.At present,most countries generally employ distinctive monitoring system,such as the ombudsman system,the supervisory system,unit supervisory and trial system,judicial supervisory system within the administrative system.China's current administrative supervisory system is also one of them.China's current administrative supervisory system began to take shape in 1990 s.With the deepening of China's reform and opening up process,and the rapidly development of economic and social,there are plenty of systemic problems demanding prompt solution.Hence,in November of 2016,the Central Committee of CCP carries out the establishment of the Commission's reforming experimental unit in Beijing,Zhejiang province,Shanxi province.This move aims to integrating the existing major public power and monitor power into the establishment of the supervisory committee.It establishes unified public power supervision and supervisory & anti-corruption agencies from national legal level.This study adopts various research methods,such as investigation research,literature research method,comparative analysis method,etc.On the basis of comparing the supervisory system past and global countries with good anti-corruption supervisory system of the country with good status in the world,this paper systematically studies the omissions and shortcomings of the present supervisorysystem in our country.It also further analyzes the existing problems of experimental unit of the supervisory committee.From the perspective of the effectiveness of monitoring work,this study proposed serial recommendations on the institutional setting,power distribution,personnel composition,legal support,supervisory and balance mechanism of the supervisory committee.This paper improves our supervisory committee regime from the blueprint concept into a specific system which is unambiguous,scientific design,and strongly operable.It is hoped that this study would make contribution to the establishment and operation of our country's supervisory committee.This thesis includes four sections.First of all,it illustrates the basic conceptual theory of administrative supervision,introducing the history of our country ' s administrative supervisory system,and summarizing the historical success and failure of the supervisory system for reference.The second section provides inspiration for China ' s supervisory system through the comparative analysis of European and American countries' and Hong Kong's regional supervisory system characteristics.The third section sheds light on the present supervisory system of China,and analyzes its problem and reasons.Meanwhile,this section introduces the supervisory committee's experimental unit.In the fourth section,the study puts forward thorough suggestion and countermeasure for the establishment of supervisory committee system.
