Restricting power is an eternal theme in the development of human politics and society.Although the purpose of different regimes and different societies to restrict power may not be exactly the same,the purpose of punishing corruption should be common.As a way of restricting power,the supervisory system has struggled with corruption for thousands of years.With the rapid development of human society,the power of the government is expanding,and the struggle between supervision and corruption is becoming more and more intense.In this struggle,all the countries of the world have established their own special supervisory system.In the period of the Warring States period,China appeared the embryonic form of the supervisory system,and was continuously developed and perfected in the following thousands of years.After the founding of People's Republic of China,the monitoring system has been repealed by several times,and the fast track to stable development has been made in 1980s.Under the impact of marketization tide brought by reform and opening up,corruption governance is facing increasingly severe situation.Scattered and inefficient supervision system is more and more difficult to meet the needs of new anti-corruption work.In November 2016,the Central Committee of the Communist Party of China launched the pilot scheme for the reform of national supervisory system in Beijing,Shanxi and Zhejiang,which officially sounded the clarion call for the reform of the supervisory system.The core measure of the reform is to set up a supervisory committee,and where will the new supervisory committee lead the reform?This article focus on the reality of the latest supervisory system reform in China,exploring the power allocation of the supervisory committee under the background of supervisory system reform.The analysis based on the authoritative documents of the Central Committee of the CPC and the NPC,as well as the Constitution and supervision law.As for the structure of the article,this paper uses the relevant theories and principles of political science,and the research ranges from macroscopic microscopic details.By looking through the actual current commission established by the analysis of the powers of the Commission nature and scope of such issues,we can clarify the contradictions and problems facing the commission power allocation and put forward some suggestions.The main issues involved in this paper are as follows.Firstly,by carding the historical context of the supervision system reform,summarize the experience and lessons of power allocation,and lay the foundation for the following research.Then,the second chapter introduces the background and process of setting up the supervision committee,the core measures of the supervision system reform,to prepare for discovering and solving problems.Next,the basic factors that influence the power allocation of the supervisory committee are analyzed,mainly involving three aspects:the name of the supervisory committee,the nature of the power of the supervisory committee,and the limit of the full coverage.In addition,the fourth chapter studies the basic contradictions in the power allocation of the supervisory committee and the problems in the supervision system reform.A basic contradiction exists between the centralization of power and the guarantee of rights,and the other exists between the anti-corruption efficiency and procedural justice.The problems in the reform of the supervision system include the fact that the anti-corruption investigation and the criminal investigation are not easy to distinguish,and the lien is easily abused.Finally,the rationalization proposal about the power allocation of the supervisory committee is put forward in order to properly deal with the basic contradictions and the problems found.
