Research On Legal Issues Of RMB Cross-border Settlement

The establishment of the Asian Infrastructure Investment Bank,the acceptance of the special drawing rights of RMB by the International Monetary Fund and the implementation of “Belt and Road” strategy,have contributed to the increase in the proportion of the total cross-border payment in RMB internationalization.The continuous development of China's import and export trade and cross-border electricity supplier also greatly promoted the development of cross-border RMB payment in China.China's first free trade zone in Shanghai in the cross-border RMB payment has pilot achieved good results,and then China established a more comprehensive cross-border RMB payment system in other regions and areas.With the widespread spread of the RMB cross-border payment applications,the legal supervision of cross-border RMB payment issues should also cause all aspects of attention.RMB cross-border payment process may appear a variety of problems,The existence of these problems affects the smooth progress of China's cross-border RMB payment,so it must be based on specific circumstances to develop a more comprehensive legal regulatory strategy to ensure he customer's financial security and financial markets during the RMB cross-border payment and the good development of the foreign trade market.This thesis mainly studies the legal regulation of RMB cross-border settlement.There are four chapters in this thesis :The first part is about the current situation and the legal regulation of the RMB cross-border settlement business.First of all,from the practical aspects of the RMB cross-border settlement and payment of the existing three common patterns,namely,clearing bank model,agency model and the RMB NRA account(domestic non resident account)model;Secondly,analyzes the status quo of the legal regulation of the liquidation of cross-border RMB payment the status quo of legal regulation of cross-border RMB payment and settlement,the legal regulation of cross-border RMB settlement business was put forward from two aspects: the legal system framework of cross-border people's currency business and the regulatory framework,then analyzes the legal regulations of cross-border payment agencies to carry out payment business.The second part is about the legal regulation of cross-border RMB settlement business.First of all,this thesis puts forward the existing problems of the legalregulation of RMB settlement business from the aspects of the legal system of the RMB cross-border settlement business and the management system of the payment institution;Secondly,this paper analyzes the causes of the above problems in detail.The third part is about the analysis of the legal regulation mode of cross-border payment of relevant countries and international organizations.The main research and analysis is on the United States electronic payment and settlement supervision system,the supervision of cross-border payment system in UK,the supervision of cross-border Payment institutions in Japan and the EU's electronic payment service provider's regulatory model.The fourth part is about the reflections on perfecting the legal regulation of RMB cross-border settlement.This article is mainly from the establishment of Payment and settlement as the core of the regulatory framework to strengthen cross-border supervision of cross-border cooperation and cross-border payment supervision should be adapted to the degree of internationalization of the currency the point of view of the establishment of relevant countries and international organizations in cross-border payment given the revelation of our country.And then,this article puts forward the improving way to perfect the legal regulation of cross border RMB settlement business from two aspects: regulatory practice of RMB cross-border settlement and the improvement of basic legislation.
