Setting Up Police Auxiliary Personnel's Auxiliary Law Enforcement Power Feasibility Study

China is at a stage of rapid economic development of the largest population in the world,is currently in a period of rapid social transformation,with the rapid development of economy and produce some of the more complicated and not easy to reconcile conflicting interests,social instability increased dramatically.Due to all sorts of reasons,the front of the public security organs is pushed to the various interests dispute mediation the law enforcement,expanding the scope of work is increasing,and should not have more responsibility,and the public security organs of the people's police personnel but not a massive increase,this is the number of police and the biggest contradiction more and more arduous tasks do not match.All levels of government and grass-roots public security organs in practice to develop auxiliary police officers and a large number of police auxiliary personnel involved in law enforcement has become the grass-roots public security organs to solve the shortage of police law enforcement especially the inevitable choice of a serious shortage of police,police officers assisted the public security organ is in the actual work will inevitably involve the most controversial and most contradictory the strong involvement of the social order and adjust the relations between the interests of "law enforcement" issue: whether separate law enforcement,whether assisted in law enforcement issues.And then assisted in three basic problems of law enforcement activities: a legal nature--power or right,and is What powers(rights)? Two,the legal issues of identity--the public security organs within the general staff,civil society,police assistant,auxiliary police officers still need special independent provisions?Three,the legal status of the subject of law enforcement or non-law enforcement body? Discussion of these issues is the focus of this paper.This paper based on the auxiliary police officers and law enforcement system of right of domestic vertical development of Hongkong region and abroad related system comparative study leads to the most pressing complicated and important auxiliary police officers of the "law enforcement" problem;and then around how to solve the problem of "law enforcement" are discussed in this paper.Then clear thepolice auxiliary personnel of non enforcement of the main identity,it does not have enforcement powers,law enforcement shall only be exercised by the people's police has the qualification of law enforcement and legal practice;finally through the two aspects of a police auxiliary personnel involved in the enforcement work exercise is an independent power-law enforcement And the necessity and great practical significance of setting up the auxiliary law enforcement power of the public security organs of the police auxiliary personnel in our country.
