The Auxiliary Police Staff Law Enforcement Personnel Research In China

The issue of social security has resulted in a great demand of auxiliary police staffs in reality. In this case, discussion on the law enforcement power of auxiliary police staffs is not only an issue of legal logic reasoning, but also a choice concerning people’s rights and interests. "Public Security Bureau Auxiliary Police Staffs Management Measures" (Exposure Draft) recently issued by the Ministry of Public Security is a positive response to auxiliary police staffs as an important force long existing in the police diversification system. In this paper, the overview, development course, classification and status of auxiliary police staffs in China are briefly introduced; auxiliary police staffs’auxiliary law enforcement in accordance with the principle of legal purpose, as well as the application of legal reservation principle in auxiliary police officers’law enforcement, are discussed, thus analyzing the legal basis for the legality of auxiliary police staffs’ auxiliary law enforcement; the nature of auxiliary police staffs’ auxiliary law enforcement is analyzed, the position of auxiliary police staffs as administrative assistants is affirmed, and their status of national staff is discussed; on this basis, the scope and boundary of auxiliary police staffs’ auxiliary law enforcement are studied, and the consequences of law enforcement are discussed, with a view to regulating auxiliary police staffs’ auxiliary law enforcement from the perspective of perfecting legislation, and promoting diverse construction and development of public security forces in administration by law.
