Research On The Perspective Of Public Judgment Documents

With the deepening of the reform in the judicial field in our country,as the legal nature of the judicial organs of the rule of law and the inherent requirements of the law,Judicial openness attracts increasing attention.Judicial openness is not only the reflection of social development to a certain extent,but also the inevitable requirement of building a socialist legal system in our country.At present,our country has made some achievements in the study of the judicial openness system,but most of them still remain on the theoretical stage.The judgment document is the carrier of the real record of the trial process,the facts of the case,the decided results and the reasons for the decision,and it is also a dual carrier of substantive justice and procedural justice.It is the inevitable requirement of the judicial openness,the basic guarantee to realize the socialist legal system,and also a mirror reflecting the authority of the judiciary and whether the judgment is fair.Therefore,only by way of the development and improvement of the judicial public system,can the achieve social justice be achieved in a sunshine way;only the development and improvement of the system of judicial documents publicly,to judge forced to enhance writing skills,enhance legal literacy,improve the quality of handling cases;only the development and improvement of the judicial public system,to curb judicial corruption,increase judicial transparency,establish judicial authority.At present,the system of public judgment documents in our country has formed a set of relatively perfect system from the law and regulationsto the specific system through the continuous exploration and practice.However,compared with the developed countries in Europe and America,the open system of the referee instrument in our country is still far from the public security system,open channels,the contents of the public or from the open procedures,etc..Therefore,based on the status of public judgment documents in our country,combined with China's special legal construction environment,using the method of empirical analysis,by learning and absorbing the advanced experiences of other countries,so as to China's judgment system further improved to provide a useful reference for China's judicial reform,further put forward their own advice.
