On The Trade Remedies Of China-Australia Free Trade Agreement

China and Australia launched negotiation for the China-Australia Free Trade Agreement(hereinafter referred to as the ChAFTA)in 2005 and completed it in 2015.The whole process lasted for over 10 years,therefore,the ChAFTA is quite rich in its content.After its one-year implementation,the ChAFTA has brought about massive benefits and interests to both countries.As the safety valve for free trade,trade remedies play an important role in the practice of the ChAFTA:Efficient and effective trade remedy measures can assist domestic industries as a powerful weapon while an out-of control abuse may lead to economic disorder and set back China and Australia's trade growth.Thereof,study on the ChAFTA trade remedies ought to be promoted as to prevent them from being abused.The ChAFTA trade remedies are bilateral safeguard measures,global safeguard measures,anti-dumping measures and countervailing subsidies measures.Compared to trade remedies under World Trade Organization(WTO),the ChAFTA trade remedies add bilateral safeguard measures,raise higher standards on transparency and consultation,however fail to deal with special safeguard measures and sensitive matters.Compared to trade remedies under other free trade agreements,the ChAFTA bilateral safeguard measures require more conditions and procedures;but anti-dumping measures and countervailing subsidy measures under the ChAFTA have shortcomings.For this reason,the ChAFTA trade remedies need to be improved on the one hand for suitability and maneuverability and on the other hand for functionality.The suggestions are as follows: First,adopting bilateral safeguard measures preferentially in the transition period;Quantifying import increase,serious injury,threat of serious injury ect.if possible.Second,consulting more to restrict the initiation of and confine the implementation of anti-dumping measures and countervailing subsidy measures.Third,launching negotiations for special safeguards and fourth,setting up a specific body for trade remedies to study and talk about related issues.
